2. Purpose

These General Terms and Conditions of Sale (GTC) set forth the rights and obligations of MAT BATIMENT OCCITANIE and its business customers in connection with the sale of new or used equipment for the construction, agriculture, and lifting industries. Placing an order constitutes full and unconditional acceptance of these GTC.

3. Products

The equipment offered by MAT BATIMENT OCCITANIE complies with current European standards. The descriptions, specifications, and images provided are for informational purposes only. The company reserves the right to modify certain technical specifications provided that overall performance remains equivalent or improved.

4. Order

Each order is subject to a customized quote. It becomes effective upon the customer’s written approval and, if applicable, payment of a deposit. Acceptance of a quote constitutes a contractual commitment and acceptance of these Terms and Conditions.

5. Price

All prices are listed in euros, excluding tax (excl. tax). The applicable VAT is added to the invoice. Additional charges (delivery, options, installation) are specified in the quote. MAT BATIMENT OCCITANIE may change its rates at any time, but the price agreed upon at the time of the order remains fixed.

6. Payment Terms

A deposit may be required at the time of order. The balance is due no later than upon delivery or within 30 days of invoicing. In the event of a delay:
  • Penalty: Three times the statutory interest rate
  • Lump-sum compensation: €40 (Article D441-5 of the Commercial Code)
  • Pending orders suspended
No discount for early payment.

7. Delivery

Delivery is made by a carrier to the agreed-upon address. Delivery times are approximate unless otherwise agreed in writing. No delay shall justify cancellation or compensation without the express consent of MAT BATIMENT OCCITANIE.

8. Receipt of Goods

The customer must inspect the merchandise upon receipt. In the event of a defect or non-conformity, any reservations must be noted on the delivery slip and confirmed by email within 48 hours to contact@matbo66.fr.

9. Warranties

Our equipment comes with a 12-month warranty (parts only), unless otherwise specified. The following are not covered: wear-and-tear parts, misuse, lack of maintenance, or unauthorized modifications.

10. Liability

MAT BATIMENT OCCITANIE’s liability is limited to the pre-tax amount of the order. No compensation will be payable for business losses or consequential damages.

11. Force Majeure

In the event of unforeseen circumstances (such as a strike, health crisis, or natural disaster), contractual obligations are suspended without penalty. The contract resumes as soon as normal conditions are restored.

12. Retention of Title

The goods remain the property of MAT BATIMENT OCCITANIE until full payment has been made. In the event of default, the company may repossess the delivered goods without any legal proceedings.

13. Governing Law – Jurisdiction

These Terms and Conditions are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the Commercial Court of Perpignan.
